“From Archetypes to Architects: Envisioning a Role Morality for Trial Level Judges”
While much has been written on the responsibilities of being a judge, there has been relatively little discussion of the role morality of judges, especially trial level judges in Canada. The current dominant debate, which casts judges as either “activists” or “passivists”, provides little insight into the realities and challenges of trial level judging. Professor Devlin argues that there is a better way to conceptualize the role morality of judges: judicial architects.
