2008 Farris Lecture
Speaker: Professor Bruce MacDougall
Topic: “Claiming Gains-Based Damages for Breach of Contract”
Damages for breach of contract are ordinarily calculated from the perspective of what the plaintiff has lost. A calculation of damages based on what the defendant has gained is rare, but recent English and Canadian cases raise the possibility that such a claim might be made in some contexts. This talk will consider what those contexts might be and what the legal basis is for such a claim. The question will be raised as to whether such compensation is even properly called damages.

On-campus Federal Court Hearing
The Federal Court will be hearing Matin Marshall v. Canada (Minister of Citizenship andImmigration) at the UBC Faculty of Law. This is an immigration judicial review application in which the applicants are seeking to set aside the decision of the Immigration and Refugee Board of Canada rejecting their refugee protection claims. The Federal Court normally sits at the Federal Courts building downtown; however, by way of a special initiative, this hearing has been scheduled to take place in the Moot Court Room at the UBC Faculty of Law.

"The North: Whose Country Is It?"
Speaker: Mr. Thomas R. Berger, Former Supreme Court Judge and UBC Law Alumnus
The Cognitive Systems Program is pleased to announce a lecture by Mr. Thomas R. Berger - a pre-eminent legal figure in the history of BC. He was counsel for the Nisga'a nation of B.C. in a case in which the Supreme Court recognized the place of Aboriginal rights in Canadian law. He was the youngest judge appointed to the Supreme Court in the 20th Century, and served for 12 years.

Annual UBC/UVic Moot
The 26th annual UBC/UVic Moot involves teams competing for the Begbie Trophy.  The moot takes place in two divisions:  Division 1, UBC v. UVic, courtroom 50; and Division 2, Courtroom 60,  UVic v. UBC.  Two pairs of mooters from each school will argue two simultaneous appeals before panels of 3 judges drawn from the BCCA and BCSC judiciary.   This year’s problem, in tort, is based on Mustapha v. Culligan of Canada Ltd. Currently on appeal to the SCC, the case involves reasonable foreseeability and psychiatric harm arising from finding a dead fly in bottled water.  Everyone is welcome to attend.
